The terms "we," "us," and "our" refer to Simpleigh & Proper, a vintage and retro print-on-demand shop based in Atlanta, Georgia. Our store is powered by Shopify. These Terms of Service govern your use of our website, products, and services (collectively, the "Services"). If you do not agree to these Terms, please do not use our Services.

By using our Services, you confirm that you are at least the age of majority in your state or province of residence. You are responsible for maintaining the security of your account and all activity under it. Accounts may not be transferred or sold to another person.

When creating an account or placing an order, you agree to provide accurate, current, and complete information, including your email address, billing details, and shipping information.

Simpleigh & Proper offers vintage and retro-inspired products produced through print-on-demand (POD) manufacturing via our partner Printify. Each item is made to order, which means your product is created specifically for you after your order is placed.

We make every effort to accurately represent our products, including colors and design details. However, due to differences in monitor settings and devices, the colors of products you receive may vary slightly from what you see on screen. Product descriptions and availability are subject to change without notice.

When you place an order, you are making an offer to purchase. Simpleigh & Proper reserves the right to accept or decline any order at its discretion. Your order is not accepted until we confirm it and your payment is successfully processed.

Because our products are custom-made to order through Printify, we are generally unable to accommodate cancellation requests once an order has been accepted and sent to production. Please review your order carefully before submitting. If we need to cancel or modify an order, we will contact you using the information provided at checkout.

Your purchases are subject to our Refund Policy (see separate document).

Prices are subject to change without notice. The price charged will be the price in effect at the time your order is placed, as confirmed in your order confirmation email. Prices do not include applicable taxes, shipping, or handling charges unless expressly stated.

We may offer promotions from time to time. Promotional terms will govern in the event of any conflict with these Terms. You agree to provide accurate payment information and authorize us to charge your selected payment method for the total amount of your order.

As a print-on-demand business, all orders require production time before they are shipped. Estimated delivery times are provided as a courtesy and are not guaranteed. Simpleigh & Proper is not liable for delays caused by Printify's production process, shipping carriers, customs, or events outside our control.

Once your order has been handed to the carrier, title and risk of loss transfer to you. Shipping confirmation and tracking information will be sent to the email address provided at checkout.

All content on our Services — including but not limited to our designs, graphics, text, logos, and product imagery — is owned by Simpleigh & Proper or its licensors and is protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or use any of our content for commercial purposes without our prior written consent. Unauthorized use of our intellectual property may violate federal and state law. All rights not expressly granted herein are reserved.

Our Services may include access to third-party tools or links to external websites. These are provided "as is" and we have no control over, and accept no liability for, their content or practices. Your use of any third-party tools or sites is at your own risk. Please review the third-party's own policies before engaging with them.

Simpleigh & Proper is powered by Shopify. However, all sales and purchases are made directly with Simpleigh & Proper. Shopify is not responsible for any aspect of your transactions with us, including any injury, damage, or loss resulting from purchased products. By using our Services, you release Shopify and its affiliates from any claims arising from your purchases.

All personal information we collect is subject to our Privacy Policy, available at simpleighandproper.store. Information you submit may also be subject to Shopify's Privacy Policy. By using our Services, you acknowledge that you have read and agree to both policies.

By submitting any feedback, reviews, or suggestions to us, you grant Simpleigh & Proper a perpetual, royalty-free, worldwide license to use, reproduce, modify, and publish that content for any business purpose. You represent that you own all rights to the content you submit and that it is accurate and truthful.

We are not obligated to maintain confidentiality of, compensate you for, or respond to any feedback. We reserve the right to remove feedback that we determine to be unlawful, offensive, or in violation of these Terms.

We reserve the right to correct any typographical errors, pricing inaccuracies, or product description omissions at any time without prior notice, including after an order is placed. In such cases, we will contact you using the information provided at checkout.

You agree to use our Services for lawful purposes only. You may not use our Services to: violate any applicable laws or regulations; infringe on the intellectual property rights of others; transmit spam, malicious code, or false information; scrape, crawl, or harvest data from our website; or engage in any conduct that restricts or harms others' use of our Services.

We reserve the right to suspend or terminate your account at any time for violations of these Terms.

TO THE FULLEST EXTENT PERMITTED BY LAW, SIMPLEIGH & PROPER SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, PUNITIVE, SPECIAL, OR CONSEQUENTIAL DAMAGES ARISING FROM YOUR USE OF OUR SERVICES OR PRODUCTS, INCLUDING BUT NOT LIMITED TO LOST PROFITS, LOST DATA, OR REPLACEMENT COSTS.

You agree to indemnify and hold harmless Simpleigh & Proper, Shopify, and our respective affiliates, officers, directors, employees, and agents from any claims, damages, or liabilities arising from: (1) your breach of these Terms; (2) your violation of any law or third-party rights; or (3) your use of our Services.

These Terms of Service shall be governed by and construed in accordance with the laws of the State of Georgia, United States. You consent to the exclusive jurisdiction of the state and federal courts located in Atlanta, Georgia for any disputes arising under these Terms.

We reserve the right to update or modify these Terms at any time. Changes will be posted on this page with an updated effective date. Your continued use of our Services after any changes constitutes your acceptance of the revised Terms. It is your responsibility to review these Terms periodically.
